Alabama Drug Possession Penalties
Possession of marijuana for personal use is a Class A misdemeanor, punishable by up to one year in jail and a $6,000 fine, and also triggers a 6-month driver's license suspension. Possession for any purpose other than personal use — or possession of any other controlled substance — is charged as at least a Class C felony, carrying a prison term of one year and one day up to 10 years and a fine of up to $15,000.
If you have a prior felony conviction, sentencing is enhanced further:
| 1 prior felony | Class C possession sentenced as Class B; Class B possession sentenced as Class A |
| 2 prior felonies | Class C possession sentenced as Class A; Class B possession punishable by 15 years to life |
| 3 prior felonies | Class C possession punishable by 15 years to life; Class B possession punishable by 20 years to life |
